I think if someone kills, rapes, tortures, maims, or is found guilty of child molestation, and other violent crimes that could or would have to be evaluated to see if the Death Sentence is a possible punishment in the crime(s) that were committed (Each Crime would have to be examined to see if they qualify for the death sentence) I think cases where a,the defendant causes DEATH to a,an innocent victim(s) and that can be proven without the benefit of any doubt and the case is solid, IE, proof backed by DNA evidence and or an EYEBALL witness that has absolutely no credibility issues then I say yes sometimes the Death Sentence is warranted...
On the otherhand if anybody convicted of any of the above mentioned crimes is believed to be guilty but there is NO DNA or lesser evidence suggests a person maybe innocent or wasn't the actual perpetrator and is found guilty only by association or circumstantial evidence then I say the defendant facing the death sentence (but the case didn't have air tight evidence then a sentence of life in prison until stronger evidence can be acquired / presented in the case would have to be issued) only because a shadow of doubt exists that could possibly exonerate or show a defendant played a lesser role in a death sentence case is proven.
I think each and every case is unique in every incident that occurs and the crimes in question that are committed would have to fall into a certain realm of severity where the CRIME or OFFENSE (again in question) could or would be deemed a situation where the Death Sentence is suitable and could very well be a possibility. :2 cents:
