California's top court overturns gay marriage ban

SAN FRANCISCO - In a monumental victory for the gay rights movement, the California Supreme Court overturned a voter-approved ban on gay marriage Thursday in a ruling that would allow same-sex couples in the nation's biggest state to tie the knot.

Domestic partnerships are not a good enough substitute for marriage, the justices ruled 4-3 in striking down the ban.

Gov. Arnold Schwarzenegger, who has twice vetoed legislation that would've granted marriage rights to same-sex couples, said in a news release that he respected the court's decision and "will not support an amendment to the constitution that would overturn this state Supreme Court ruling."

The Legal concept from what I have heard that the court based their decision on is that marriage is a "natural" right like speech or even breathing was mentioned as a comparison(and that was by the judge on Fox lol).Those kind of rights are not at the whim of voters.It would take at the least a constitutional amendment to overturn the decision.Similar to how voters cannot vote on abortion rights.

Good for gays and lesbians. Why the fuck shouldn't they be allowed to be married and have all the benefits that said union has to offer them? It must be tough enough for them being treated badly by so many for so long simply because most (though I doubt all) of them were born genetically predisposed to desire only their own sex.


BTW; Now if I kill someone in California and I have a male accomplice I can marry him and then they can't ask us to testify against each other at our trial; right? And then once we are aquitted, we can get an annullment (seeing as I am not gay).

I agree... It is not my place to judge what others seek in their private life.
They pay taxes and have the same rights as anyone else in my book.

'Marriage' is a human made word. That means that the word can mean anything that human's decide that it means. And since law's in America are made, in the end, by the courts; then the courts have spoken (apparently) that the word 'marriage' in the state of California now means a union between gays and lesbians also.


BTW. Has anyone else noticed that gay male couples seem to usually be better looking humans then most lesbian female couples? Why is that?
Don't believe me? Watch a gay pride parade sometime. Even the highlights on the news; you will see what I mean.

I think that California didn't have civil union before. I know that a lot of places don't and in some of those that do, it's not considered to be a legally binding contract and entail the same rights and responsibilities as marriage.
