This is not and never has been a direct democracy where everything is up for a vote.While I personally not being gay am not that worked up one way or the other about gay marriage (even though I started the thread lol) the arguement that just because the majority will or won't vote for it is not relevant to me.If we left everything up to a vote ,many protections and rights in america would be really in peril.
As an example it was courts that decided blacks were being denied rights (like segregated schools being unfair and unequal) in spite of their being a majority that really did not want that changed.One of the founding principals of our country was that some rights were not up for votes and that you needed to protect rights of minoritys from the whims of the moment by majoritys.

Like what the courts found in the 50s and 60s pertaining to blacks ,that segregation and jim crow laws were unconstitutional is what the California supreme court found regarding gay marriage.
Whether you like these particular outcomes or not this how our system is suppose to work and what the courts are for.To decide if laws are constitutional or not and if they aren't and violate rights, to overturn those laws ,no matter how popular they may be.

This has never been a Democracy. We are a Constitutional Republic.
The Supreme Court is supposed to go by the Constitution and the Bill of Rights.

When the vote of the people to oppose "gay" marriage was over turned everyone should have stopped working until their vote was upheld. What the judges did is unconstitutional and every judge who voted to overturn the people's vote should be fired and then hanged in the town square.

Isn't the gay marriage issue one of same sex couples having equal legal rights, such as social security & pensions benefits, tenancy rights etc. Why should two people of the same gender be penalised by not having the same lawful rights as married people of the more 'traditional' type?

So your saying that when the slavery was legal that must have been just because the population believed it was? Still does not make it right and equal. Same here. You could say that for just about every single law in the United States. For example, sodomy is illegal in quite a few states. That doesn't effect you or I (unless we are the ones getting assfucked), but I don't see many people making a stand for or against the sodomy laws.

A few states. Most sodomy laws have been struck down by individual states, or by Lawrence v. Texas (although the court has been vague about whether this just applies to homosexual sodomy). And laws remaining are rarely enforced.

It isn't supposedly or supposebly anything. It is a genetic tendency. Yea, when it comes to having a partner's lover in the hospital on their death bed yet the hospital won't let them see their lover. That is not equal rights. It's not just for the economic reason's. They should be accepted in our society completely not put down or bashed as so many have done. If you don't know what is like to be gay and go through that. You really shouldn't keep a person from their rights. I mean honestly what guy would rather have cock instead of pussy. It is no way a choice. Along with that the bashing they go through....

i just don't understand the threat gay marriage poses to anyone. if a church is willing to marry gays so be it. on the other hand no church should be interfered with by the government for not being willing to marry gays. also for the problem of the supreme court overturning what people vote for in the past the people have supported things like: slavery, jim crow laws, extermination of indians, etc...the supreme courts purpose is to evaluate issues as they relate to the constitution nothing more, nothing less. are gay marriages prohibited by the constitution? do gay marriages do damage to constitutional law? these are the kind of question the court will be evaluating.

Luckily it's slowly changing but society has always tried to force it's view of what's acceptable on us. If you add up the number of homosexuals and bi-sexuals in the United States, can you really say that you're in the minority anymore?

Maybe I say this because I grew up in a suburb that has the 2nd highest amount of gay people per capita in the US and then lived in Chicago for a while, but it's not uncommon for someone to be gay anymore. Homosexuality, from what I've seen, is actually getting more popular with each and every day.
