Demjanjunk Is Gone...

My dad had a follow up appointment for his kidney stones at the hospital this morning, so I drove him there. After his appointment was done, I dropped him off at work. This was about an hour and a half ago and, while I was in the Federal Building here in Cleveland, a lot of the agents were talking about how Demjanjuk IS going to be deported.

Early this morning, Demjanjuk's deportation stay was lifted and the federal government is now free to deport him at any time. Plans were being set this morning to take him away this afternoon.

Also, I don't know if this made national news, but there is video tape of Demjanjuk about one week before he was seen in a wheel chair, moaning of pain, in which he was walking around with free will. This video was taken by the office that my father works for and was used in order to lift his deportation stay, disproving his claim that moving him would be "torture".

They tried him and re tried him until they got a conviction for something. This has been going on for 27 years.

The Israeli Supreme Court declared there to be insufficient evidence to declare him "Ivan the Terrible" (who was accused of being) The Israel Supreme Court also said it was likely that he was a prison camp guard.

Demjanjuk was released to return to the United States. In 1993, the Sixth Circuit Court of Appeals ruled that he was a victim of prosecutorial misconduct, as federal prosecutors had deliberately withheld evidence, and his US citizenship was restored.

So he came back to the US and they decided to charge him with being a guard at a camp in Poland. At worst all he was, was a gaurd at a camp.

The Ukraine and Israel both declined to prosecute him for being a prison camp guard. Germany agreed to try him so he and apparently he will be extradited this week.

If all he was was a prison guard, does that mean that Germany will now prosecute ALL the Germans in their jurisdiction who were Nazi prison guards? Or are they prosecuting Demjanjuk because he was Ukrainian then fled to the US after the war?

I have to agree with Baill Inneraora.

Israel already dismissed this because of insufficient evidence.
But, the American government just couldn't drop the issue.
Even though they have commented many crimes that makes whatever he did pail in comparison.

I guess Bush and Cheney will be tried and the rest of Bush's Nazi group?

The law enforcement branch of the Immigration and Naturalization at Cleveland is also waiting for orders from the Justice Department in Washington before taking him in.

The issue is whether the Supreme Court will hear the appeal or let the lower court to stay its decision.

If there was direct evidence against Demjanjunk, you can be assured that the Israeli's would have tried to have prosecuted Demjanjunk.

The fact that there was wasn't direct evidence, they had no choice but to release him.
And they would have tried every single avenue to bring evidence against Demjanjunk.

I used to live in Cleveland Height and knew about this case for over 23 years.

The fact Demjanjuk's family never built a handicapped access ramp in their house raised a lot of questions.

The Immigration Enforcement officers had to take 45 min-1 hour to get Demjanjuk out of the house proved a fact:

Demjanjuk already is a prisoner in his own house. Demjanjuk never goes anywhere except doctors' visits (?) Demjanjuk's cause somehow pulled his family together. His daughter's ex becomes the spoke person of the family and his son is lauching the last ditch in the Supreme Court to fight extradition from Germany.

Germany also has free universal health care.

But it would appear that there is no actual evidence that Demjanjuck actually killed anyone.

The Israeli's would have come up with something if there was even a sliver of evidence - they'd do anythnig to try to prosecute alleged WWII war criminals.

The fact that the Israeli's couldn't assemble any evidence against Demjanjuck speaks volumes.

My father works for DHS/INS. He helped organize the team that obtained the video evidence of John Demjanjuk walking around just fine, mere days after he was apparently too crippled and in pain to be transported. You can see portions of that video here...

Demjanjuk was then, according to the prosecutors, brought to a German prisoner of war camp in Kulm in July 1942. Prosecutors claimed that Demjanjuk volunteered to collaborate with the Germans and was sent to the camp at Trawniki, where he was trained to guard prisoners and was given a firearm, a uniform, and an ID card with his photograph. The principal allegation was that Demjanjuk was "Ivan Grozny" or "Ivan the Terrible" of Treblinka, who operated the diesel engines sending gas to the death chamber.[8] Prosecutors based part of these allegations on an ID card, but defense attorneys countered that the card was forged by Soviet authorities to discredit Demjanjuk. The card had Demjanjuk's photograph, which he identified as his picture at the time, as well as signatures of various Nazi officers who were deposed and confirmed the authenticity of their signatures. The paper and ink on the card were tested by internationally renowned experts who confirmed that the card was authentic. The original of the card was presented in court in Israel as supplied by the Soviets.[9] Demjanjuk admitted that the scar under his armpit was an SS tattoo which he removed after the war. During the trial, Demjanjuk was again identified on the photo spread by Otto Horn, a former Nazi guard at Treblinka.[9]

On April 18, 1988, the court found Demjanjuk guilty of all charges. One week later it sentenced him to death by hanging.[10]

On July 29, 1993, five Israeli Supreme Court judges overturned the guilty verdict on appeal. Their ruling was based partly on the written statements of former guards at Treblinka that Ivan the Terrible's true surname was Marchenko, not Demjanjuk.[11] The former guards' statements were obtained after World War II by the Soviets, who prosecuted Ukrainians who assisted the Nazis as auxiliary forces during the War.
