Mom says Patriot Act stripped son of due process.

Sixteen-year-old Ashton Lundeby's bedroom in his mother's Granville County home is nothing, if not patriotic. Images of American flags are everywhere – on the bed, on the floor, on the wall.

But according to the United States government, the tenth-grade home-schooler is being held on a criminal complaint that he made a bomb threat from his home on the night of Feb. 15.

"Undoubtedly, they were given false information, or they would not have had 12 agents in my house with a widow and two children and three cats," Lundeby said.

Around 10 p.m. on March 5, Lundeby said, armed FBI agents along with three local law enforcement officers stormed her home looking for her son. They handcuffed him and presented her with a search warrant.

This is exactly why I opposed the USAPATRIOT Act. We have constitutional rights to due process as US citizens and nothing should supersede those rights.

This is on Obama right now and he needs to fix this situation in general and definitely for this kid.

This is the thing, you can't stand by and let this happen to suspects like Padilla who is an American citizen just because you think he's a terrorist.

You don't hold US citizens indefinitely, without charge, bail or trial no matter what the case.

Considering both Biden and Reid voted for the original in 2001(http://www.senate.gov/legislative/L...ote_cfm.cfm?congress=107&session=1&vote=00313) and Biden, Obama, and Reid voted to extend it in 2006 (http://www.senate.gov/legislative/L...ote_cfm.cfm?congress=109&session=2&vote=00029), I don't see it happening with this administration.

These Democrats voted this way because, in 2001, "the nation" united behind President Bush. Little did we know then how incompetent and corrupt he really was.

In 2004 and 2006 the Republicans basically smeared any attempt at changing anything initiated under them or Pres. Bush as being "anti-American" "making the nation less safe" and "cowering to terrorists.":dunno: Dennis Kucinich and Mike Gravel were the only Dem nominees who were for literally tearing up that Act. I think Kucinich said it would be the first thing he'd do the minute he sat in the chair....

The Patriot Act must be overturned. It will be a 2nd term item now that the economy has cratered. If the economy continues to slide backward down the hole there wont be anything for the Patriot Act to "protect"...

I don't see what's so wrong with this story. They had a report that the kid called in a bomb threat and they acted as if it was a serious manner, like they are supposed to do.

Would you rather have law enforcement sit back and wait for something bad to happen before they act or would you rather have them do what they did, and try to prevent innocent people from getting killed?

And, if you would read the article, the kid hasn't been charged with anything, therefore, keeping in line with INNOCENT UNTIL PROVEN GUILTY. Even if he IS charged with something, he is still going to be innocent until provent guilty...not the other way around.

People need to learn how the law works before they try and bitch about it. What is happening to this kid is most definitely an annoyance for him and his family, but nothing illegal is being done.

PS - They had a search warrant, so they had every right to search the house.

They have violated his due process rights and they found nothing that linked him to bombs or bomb making material in his home.
They don't have any evidence.

They could have called his Internet provider and confirmed he was not on his computer at the time and he was at church that day and night and never turned his computer on.

Many illegal things have been done. When this is over they have a valid lawsuit and I hope they win a large settlement.

Apparently there was a preliminary investigation, an execution of a duly authorized warrant (provided there was sufficient probable cause) and a subsequent arrest. No problem there.

Here's the problem, he's apparently being held incommunicado without access to counsel and if you are not cited, indicted or charge within 72 hrs. you're supposed to be released.

The government can't simply arrest someone and detain them indefinitely without charging the person and having a bail hearing. That is in effect, state sponsored kidnapping.
