A Swiss woman has lost her job after her employers spotted she was using the Facebook website when she had claimed to be too ill to use a computer

It depends..if she confessed to ditching work and suggested she wasn't really sick...then it's no different from claiming to be sick and your boss running into you at the local bar at lunch time...

I think there was probably something else with this person otherwise why would her boss be scoping out her facebook profile when she's off?

she should sue them for stalking her. Either that or she works with some rats! Where I work we all watch each others back. Even those we don't particularly care for. Cause we know if one of us gets fired they are never gonna be replaced and that would make for more work for the rest of us. So something like this would never happen where I'm at!

Another good reason not to be involved with things like facebook,myspace etc where your real identity and privacy is compromised.Once you are on those its in the public domain and anyone and everyone may be looking at it.Not a good idea IMO.

Doubtful a suit like that would have much success because they didn't violate her privacy. I'm not a member of Facebook but assuming it's a web community where her profile is freely accessible to the public, whomever discovered what she was up to by using it violated no right to privacy and disturbed no laws...

The woman, who is from Basle, said she had been accessing the internet on her iPhone while in bed.

Unless they have cameras in her bedroom, how are they going to dispute that?

I have migraines sometimes and staying home is the best idea. Instead of driving and maybe killing someone. The company is only thinking about themselves and the other workers should have a walk out until she is rehired.

She said the company had created a fictitious Facebook persona which become "friends" with her, allowing the company to monitor her online activity.

Her suspicions were raised when the "friend" suddenly disappeared after she was fired, the woman told 20 Minuten daily.

This is stalking and is illegal.

Never tell anyone you work with where you are online and never post if you're off sick from work.

If you're going to post, post after your work hours are over.

If you read the link you attached, the first thing you should notice is the law has to do with harassment requiring the "stalker" to take some action using the online blog communities it outlines (i.e. posting pics, harassing messages, etc.) not merely reading it.

Secondly and more importantly, it's a California law and not applicable to anyone in Ill.

It should apply to everyone and especially businesses that stalk their employees. We have the right to be secure in our own homes and papers.
What they did would be like an illegal search. Go read the Constitution and Bill of Rights.

How is it illegal? Facebook is a public site and if her profile is public and they merely clicked on it and read...something like her blogging about ditching work or something....what law has been broken? If that was the case, I wouldn't personally fire someone for that alone as those are just words on a blog. Beyond direct evidence what's she's saying was true, I'd have a big problem taking action against her.

But what law protects you from having your profile read by someone (anyone) on a public, community website??

What they did is highly unethical and anyone finding out about this shouldn't want to work for them but I don't a single law that was broken.

"Stalking" is not just one act...it's a combination of actions designed to harass and/or instill fear.

She may have a claim for wrongful termination which is a civil matter but even that depends on Ill. state law.

No one has the right to monitor you on the net or with cameras, especially in your own home.
