Karzai signs law 'legalising rape in marriage'

President Hamid Karzai has signed a law the UN says legalises rape in marriage and prevents women from leaving the house without permission.

The law, which has not been publicly released, is believed to state women can only seek work, education or doctor's appointments with their husband's permission.

Only fathers and grandfathers are granted custody of children under the law, according to the United Nations Development Fund for Women.

Opponents of the legislation governing the personal lives of Afghanistan's Shia minority have said it is "worse than during the Taliban".

Mr Karzai has been accused of electioneering at the expense of women's rights by signing the law to appeal to crucial Shia swing voters in this year's presidential poll.

While the Afghan constitution guarantees equal rights for women, it also allows the Shia community, thought to represent 10 per cent of the population, the right to settle family law cases according to Shia law.

The Shiite Personal Status Law contains provisions on marriage, divorce, inheritance, rights of movement and bankruptcy.

The bill passed both houses of the Afghan parliament, but was so contentious that the United Nations and women's rights campaigners have so far been unable to see a copy of the approved bill.

Shinkai Zahine Karokhail, a female MP, said the law had been rushed through with little debate.

She told the Guardian newspaper: "They wanted to pass it almost like a secret negotiation, "There were lots of things that we wanted to change, but they didn't want to discuss it because Karzai wants to please the Shia before the election."

The Afghan justice ministry confirmed the law had been signed, but said it would not be published until technical difficulties had been overcome.

A spokesman for President Hamid Karzai would not comment

Is everyone 100% sure that country is better of now that the taliban are gone? Women can be raped when they're married, reporters are not allow to write or report certain things because they're offensive towards the islam...

At least with the taliban you knew in advance that you were dealing with religious fanatics...

But then again, the muhajedin have never been any better, so we could have known that stuff like this would happen as well....

Even though I dislike monarchies, I do believe that in this case the best option would have been to reinstall the former king (he's still around somewhere) and give him some limited power....

My friend that King.......has passed away...in the recent year/2yrs....He was brought in after Taliban but was never given any power by the US....he was the person liked by the masses over there......but Karzai was made president(King)...and then so called election was...held......Karzai will remain in power for life time in power........b/c..US like him.....whatever he does over there is right.....in his time the production of opium has been drastically increased................

In my opinion the people over there should be given a chance.....but from Taliban to Karzai...the common man was never given a chance to choose ...their own leadership.............everytime the rulers are installed first and then the people are asked/forced to choose him.........In such a situation.....peace in that country couldn't become possible.....for the last 7 years.....we don't know..how long more.........as that country was initially destabalized around 1980......we still .........hope for peace...:crying::crying:

It's not that long ago since rape within marriage in the UK was deemed impossible.The thinking was that making marriage vows gave implicit permission to your spouse to have sex.

While I think such laws and cultural customs are extremely regrettable and unenlightened I must say this.In another thread when someone mentioned what the rest of worlds opinion was about the US and Bush in particular you said something along the lines of that you didn't care what people in other countries thought and that they do not run the US and thier opinions are irelevent.Given that why would you expect people in Afghanistan or anywhere else to care how you or any other foreigner cares about the way they run their country?
Personally I do think that others opinions from wherever they may come from are of varying importance and both Afghanistan and the US for that matter need to take them into account.Oh and btw the opinion that Bush was a disaster as a president was also shared by an overwhelming percentage of americans as he had some of the lowest approval ratings in history.

As did other nations in Europe. The difference is that the US stopped selling to them in 1990. Many European nations did not (let alone the Russians).

This is the problem we face actually. Conservative-minded people, or "Neo Ron Paulian Centrists" seem to be changing history already and we've only had 1 Qtr of Obama's First term.

It appears that the Conservative members of this forum, as a collective, had no idea that Obama and the Dems didn't want to try to "tax cut and spending cut" our way out of the economic mess. The McCain Approach of "if we bury our head in the sand, maybe it will all blow over and we'll magically return to 1988" platform ain't really realistic. It's immature.

Grown ups are needed to make difficult decisions now.

As for this post--if true--it represents a sad setback in our "Democracy Building" in Afghan and it represents further why we are simply wasting our time and money in that part of the world.
