mom fled with son after court orders him to get chemo

I dont know why people have this inherent fear of doctors?

She can go to as many herbalists as she likes, her son is still going to die without proper treatment, treatment that has shown to have positive effects, where as where are all the peer reviewed journal articles on the positive effects of herbal remedies that can cure or treat Hodgkin’s lymphoma.

This is a type of cancer that can be treated successfully with proper treatment if caught early:

Most patients who are able to be successfully treated (and thus enter remission) generally go on and live long and normal lives, due to a remission success rate of 90% to 95%. (Wikipedia)

Sorry about the Wikipedia reference :D.

But once again we seem to have a person who has been given the wrong information either by the religious group she frequents or somewhere else. Once her son dies, because he will without treatment. Arrest her for neglegence because this will be no one elses fault but hers. That might seem harsh, but it's true.

I don't like what she's doing, and it's stupid, but I also believe, as long as they aren't infections our will hurt others, that a child's parents should be able to dictate what medical treatment their child gets. Even if that might not be what other people think is best for them, including me.

i dont know touchy subject but if he dont want too then thats his right

That is his right! Since when is it the governmets right to order what treatments people should recieve. But, beyond that Chemotherapy is a terrible treatment, since one side effect is not being able to hold food down. Just look what chemo did for Patrick Swayze, but atleast he made his own choice and wasn't forced to take the treatment.

Children don't have the maturity to make such decisions, thats why they have guardians. And parents who go against what the medical community knows to be his only real chance for survival are not doing their job as parents. Some people beleive in no medical treatment and think prayer and god is the answer, this is same time of parental neglect.Just because you are a parent does not give you unlimited rights especially when it is deemed to be not in the best interests/welfare of the child.

I have to agree. Chemo is hard on the body and it does not always work. At the age of 13 this child knows what is going on. He may not want chemo. Just because he is a minor does not mean that he should not have a say in his medical treatment.

Conspiracy...
Chemo....you mean radiation poisoning. ;)

He can choose whether he wants it or not.

Chemotherapy can cause cancer.

When very high doses of chemotherapy are used to kill cancer cells, these high doses can destroy the blood-forming tissue in the bones (the bone marrow). If very high doses of chemotherapy are needed to treat the cancer, bone marrow may be taken from the bones before therapy and frozen until it is needed. Following chemotherapy, the bone marrow is given back through a needle in a vein. This is called autologous bone marrow reinfusion.

Radiation therapy uses x-rays or other high-energy rays to kill cancer cells and shrink tumors. Radiation for Wilms' tumor usually comes from a machine outside the body (external radiation therapy). Radiation may be used before or after surgery and/or chemotherapy.

After several years, some patients develop another form of cancer as a result of their treatment with chemotherapy and radiation. Clinical trials are ongoing to determine if lower doses of chemotherapy and radiation can be used."

In this country (the United States), 13 year olds don't have the legal right or ability to give their consent to anything. So, unfortunately, this kid's wish to refuse medical treatment means nothing. His parents are the only ones who can make that decision for him.

Now, this is a situation where our legal system gets really confusing. Our country has religious freedom. You can practice whatever religion you want to, as long as it's not outrageous (human sacrifice, etc). The reason that our government puts a limit on what you can actually do with your religous beliefs is so people don't end up hurting eachother. In this case, the parents' religion is hurting their child, so the government is stepping in because they are truly endangering their child's health by refusing medical treatment that has been proven to work. But, the thing that sucks is that the government is stepping over the boundary of religious freedom to protect the child from getting hurt.

Personally, I think it should all be left up to the parents. Fuck what the kid wants; he's 13 and doesn't know shit about anything. His parents should be the ones who make the decision and, since they are refusing medical treatment, that's what should be happening. I don't think they should be forced to take their child to treatment if they don't want to.

That is why this country is sad. At 13 he very well knows about his illness. To say that because he is 13 he has no rights is stupid. If your parents get divorced at his age he can go to court and pick which parent to live with. In Arizona you can drop out of school after 8th grade. That is usually the age of 13. To many times the parents do not have the best wishes of the child in mind. We see stories each day that prove that. To force anyone to take chemo is plain wrong. He is old enough to have a say in his treatment. :2 cents:

So can a 13 year old consent to sex with an adult then?

Do parents have a right to let their kid commit suicide? (hypothetically)

That is a very stupid question and in no way relates to medical treatment. Sad that you have to bring sex into this thread.

That is a very relevent question.

Please answer it.

13 year old can choose to die but not to have sex??

Also what about my second question, please.

No it is not relevent. Sex has nothing to do with cancer. No one should be forced to do chemo. Are you the one that is going to get sick from the chemo? Are you the one that is not going to be able to hold food down and be throwing up all of the time? Are you the one that is going to be so tired that you can not walk? Are you the one that is going to lose a lot of weight and look gaunt? Are you the one that is going to get fevers and have a greater risk of getting illnesses? You are not going to suffer from any of the side effects that this boy will. Yet you think he should be forced to go through hell because he is not 18 yet. Chemo does not work in many cases. He could do all of this and still die. :2 cents:

Have you read the story at the link?

"Authorities believe the mother and son fled Monday after a court-ordered X-ray showed a tumor in Daniel's chest was growing. Doctors have said the tumor will likely kill Daniel without conventional treatment, but Colleen Hauser favors healing methods of an American Indian religious group known as the Nemenhah Band. "
The new warrant gives law enforcement agencies in other states the authority to detain Hauser if the two are found. But authorities said they didn't know what could be done if the Hausers have reached Mexico. Hoffmann said he hopes the pair is still in the U.S.

"I just wish we could get to Colleen and tell her to come in," Hoffmann said. "This is not going to go away. It's a court order."

Hodgkin's lymphoma is a highly curable form of cancer when treated with chemo and radiation. But the teen and his parents rejected chemo after a single treatment, with the boy's mother saying that putting toxic substances in the body violates the family's religious convictions.

Hauser said she had been treating the boy's cancer instead with herbal supplements, vitamins, ionized water and other natural alternatives — a regimen based mostly on information she found on the Internet."

To be honest I hadn't till now.She is one of those religious nuts who I had referenced earlier who is a danger to the health of her son.

I knew someone in his early 20s about 25 yrs ago diagnosed with Hodgings who with the help of chemo and radiation is still alive today. I hope the mother see's the light and gets her son the care he needs soon or someone spots them and he gets the care in spite of his mother.

Again you are missing the point. The point is about rights. Not cancer or sex in particular. Does a kid have the right to commit suicide? Does a kid have a right to disobey his parents wishes in similar cases, where the parents do want treatment.

Can kids choose what's best for themselves or not?

Does the state have the right to prosecute neglect when the child agrees to the neglect?

I'm playing devil's advocate, here. I don't agree with myself on some points.

13 year olds are stupid and don't know anything about life. He might know that he has cancer, but that's it. He doesn't know the consequences of his actions by refusing medical treatment. He doesn't understand that his form of cancer can be treated (with good results too). He doesn't understand that what he is doing is stupid. He doesn't understand that his life, that he'll never get to live, can be prolonged and/or saved. He doesn't understand that his parents will have their child die. He doesn't understand the pain, heartache and emotional turmoil that he would be lying upon his parents by letting himself die. He doesn't understand that his friends will have their friend die on them. He doesn't understand that he'll never get to experience love, happiness or life at all. There isn't a 13 year old on the face of the planet that understands any of that.

The ONLY thing this kid understands is that his parents don't want him to get chemo treatment, so he's going along with what they say. He has been raised under a certain religion with a certain set of beliefs, which he is blindly following, not even knowing what he is doing. He hasn't had a chance to experience life outside of what his parents want him to experience. His beliefs aren't his beliefs; they're his parents'.

To let this kid decide if he gets medical treatment or not is stupid. We would be putting this kid's life in his own hands. He's not smart enough or experienced enough to make LIFE SAVING decisions, especially when it comes to his own life. We might as well give this kid a gun and say "If you ever feel like killing yourself, go right ahead. It's your choice..."

The judge wrote that Daniel has only a "rudimentary understanding at best of the risks and benefits of chemotherapy. ... he does not believe he is ill currently. The fact is that he is very ill currently."
