Well, I do believe he does have the choice; but if he were to somehow put someone else in danger (that was not wearing a helmet)...because of said choice...then there should be a mandatory law that states those who are possibly endanger others while in the commission of a motor vehicle, that are not wearing proper safety devices shall forfeit said assets (money/401/pension) to any family of the other rider; as by that definition he is actively committing negligent homicide. Or another alternative is that they have to pay 4x-5x the insurance premiums as when that guy wrecks...and his insurance pays for the related expenses...it's not him that's paying...it's the fellow tax payers..... So you ride w/o helmet...be prepared to pay...both with your life or with your wallet.... It may sound cruel...but it's your choice...choices have consequences... You take/make a bad choice - pay up.
