Dang, now I know the right-wingers here on the board are always happy to lob the "soft-on-crime" b.s. my way (you know, cuz I'm not appropriately gung-ho for, say, executing shoplifters and such ), but this is ridiculous.

I'm thinking this guy should be removed from society for probably the remainder of his life - actually, I'm sure of that. Absolutely hideous crime. And I'd also suggest that the judge at issue serve at least 2-3 years. Why not?

Attorney general asks why rapist didn't face more charges

McALESTER -- Oklahoma's attorney general wants to know why a man who admitted raping a McAlester girl did not also face charges for abusing her older brother.

Two state legislators are separately calling for the removal of the judge who oversaw the controversial plea agreement that gave David Earls just one year in jail.

Attorney General Drew Edmondson said he is disturbed by the "lenient" deal struck last month with Earls, who pleaded no contest to raping and sodomizing the girl, then 4 years old.

District Judge Tom Bartheld ordered Earls, 64, to serve one year of a 20-year sentence. He was also credited for time he's spent in jail, meaning he will be released in three months.

Police initially identified the girl's brother, who was then 5, as a possible victim. Earls also faced a charge for forcing the boy to watch as he raped the girl.

But Bartheld dismissed that charge during Earls' May 13 sentencing, "based upon the recommendation of the district attorney," according to court records.

What people don't understand about this case was that this wasn't the judge's choice on the sentencing, this was the plea bargaining. The prosecutors (the D.A.) were the ones that proposed this to the defense lawyers because there was no DNA found on the child and they didn't really want the child to testify due to the horror she experienced. The prosecutors had nothing to work with on this case and this was the best they could get. Even the child's parents and some leader of an organization that works for children in these situations suggested they take it because as I said previously, the prosecutors had nothing to work with. There was no hard evidence and had it been taken to a real trial, this guy probably would have gotten off free. This way, he is on a sexual offenders list and will serve one year in jail, according to CNN, with 19 years suspended so if he breaks any sort of terms set by this plea, he has to fulfill the rest of his term. Sorry, if it sounds harsh but we do have to follow laws and lawyers and judges have to follow procedures and they did the best they could work with. I do agree, this guy should be put away for a very long time, but that is swift justice when we do need to prove beyond a reasonable doubt that a person is guilty so we have to follow our court procedures.

Have you heard about another guy who was found guilty of molesting a child and got 100 years? The reason some people are upset over this is the man only has an IQ of 47, the same as a 2nd grader. I'll look for the link.

I'm having trouble finding it, but this guy had a court-appointed attorney who didn't even bring the man's mental health into the trial even though he knew about the man's mental handicap. People actually feel this man should be let off easier because of his deficiency due to having a shitty defense lawyer. I actually agree with this though

This is the kind of stuff that kills me, I understand the lack of evidence but they need to find a way to get the info from the little girl and use that in court, whether through a therapist or someone.
I realize he has the right to face his accuser, but at her young age and the sheer trauma she went through exceptions need to be made, or laws need to change for cases like this.

You can kill 50 gang members and be somewhat respected in prison, but you won't be respected for this at all.

Why bother putting him out of his misery, you'd only be doing him a favor. Hey, if he makes it out alive you could always hunt the guy down and murder him if it really bothers you that much.
