This is extremely bad for civil liberties. Our constitutional rights have been eroded very rapidly in recent years. Conservatives (in general) hate the ACLU but claim to defend the tenets of the constitution. I have always found this to be a serious dichotomy. This may be the first ever opinion by Justice Scalia with which I am in agreement. Politics certainly do make for strange bedfellows.

I don't like this at all...it appears to me that "Innocent until proven guilty" is now right up there with the USA being a "free" country...

I wouldn't object if it was for a sex crime, or something against children. I could even get on board for serial murder, but yeah, to many rights are being taken away.

Unlike most conservatives, I do not have a real problem with the ACLU. Their approach is for the most part unabashedly radical and controversial but I believe they serve a useful purpose in America's legal system. I respect Bob Barr for recognizing this and having the chutzpa and conviction to join forces with an organization that is constantly being demeaned by his fellow conservatives. I believe this ruling is the SCOTUS' Patriot Act and offers many far reaching implications for abuse.

Slippery slope though, isn't it? I get nervous whenever they start putting an asterisk by anything in the Bill of Rights. If no warrant is needed for sex crimes in this case, then is it OK if we also search people's houses if there is probable cause? Ask Blue Countach just how hard it is to establish probable cause when the cops are determined to make a charge stick to a suspect.

Seems like a pretty slick way to build a bigger government database of DNA, that will include as many citizens as possible, to me. Major crimes today. Drunk driving and speeding offenses tomorrow.

Fuck yes it is. The thoughts bounce around my melon too...I guess I would lean towards my rethinking my thoughts, as opposed to defending them.

It will now require other cases to narrowly define the scope of the ruling...as in when I say no DNA swab, and 3 or 4 guys hold me down and take it, is it valid?
Custody would be an issue (of the sample) ala O.J. Simpson; after pissing off a few guardians of L&O, and cross contamination from officer introduced spit (accidental and otherwise), and so on and so on.

Millions of billable hours charges later, it will be litigated and defined to death, and then many other "similar" types of liberties will be taken without permission and THAT will have to be litigated...
The 21st Century is just starting, bring on the NWO. Only sorta kidding...
